----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mohd. Shakir Khan Mr. Ankit Khandelwal Mr. Anupam Sharma For Respondent(s) : Mr. Jai Prakash Tiwari, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order [2024:RJ-JP:50191] (2 of 3) [CRLMB-14292/2024] 05/12/2024 These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused-petitioners have been arrested in connection with FIR No. 281/2024 registered at Police Station Nagar District Deeg for the offence under Sections 319(2), 318(2), 338, 336(3), 340(2), 317(5), 303(2), 313 and 61 (2) (a) of BNS and Section 66D of IT Act. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. Counsel further submits that the offences alleged to have been committed by the accused-petitioners are exclusively triable by Magistrate.

The accused-petitioners are in custody since long and the trial of the case may take considerable time, therefore, the accused-petitioners may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail applications. Heard and perused the material available on record. Considering the fact that the accused-petitioners are in custody since long and looking to the fact that the case of the accused-petitioners is exclusively triable by Magistrate, therefore without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners 1. Robin S/o Ibra, 2. Rashid S/o Juber, 3. Irfan S/o Jain Khan, 4. Salim S/o Nasru, in connection with FIR No.

281/2024 registered at Police Station Nagar District Deeg shall be enlarged on bail provided [2024:RJ-JP:50191] (3 of 3) [CRLMB-14292/2024] each of them furnish a personal bond in the sum of Rs. 50,000/-with two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
