Today, a withdrawal pursis / settlement pursis is tendered which is taken on record.
As per the said pursis, the rate of interest which is awarded by the concerned Tribunal is reduced to rate of interest to 6% per annum and additional interest which is deposited by the appellant has to be refunded to the appellant insurance company. Both the advocates appearing for respective parties have agreed to the aforesaid arrangement. The remaining amount be paid to the claimant after appropriate verification by way of Account Payee Cheque. 3. Necessary Court fees, if any, be refunded to the appellant, as per the provisions of section 21(1) of the Legal Services Authority Act, 1987. 4. Registry is directed to transmit the record and proceedings to the Tribunal forthwith. 5. Since the main appeal is disposed of, connected cross objection application stands disposed of accordingly.
