HIGH COURT OF TRIPURA AGARTALA WA No. 115 of 2024 Smt. Imala Marak, W/o Late Mirendra Marak of Paratia, Udaipur, P. O. - A. R. Para, P. S. -R. K. Pur, District- Gomati Tripura ......... Appellant(s); Versus 1. The State of Tripura represented by the Commissioner-cum-Secretary to the Government of Tripura, Finance Department 2. The Executive Engineer, Udaipur Division, PWD (R&B), Udaipur, Gomati Tripura 3. The Chief Engineer, PWD (R&B), Agartala, West Tripura ......... Respondent(s). For Appellant(s) : Mr. A. Acharjee, Advocate. For Respondent(s) : None. HON’BLE THE CHIEF JUSTICE MR. APARESH KUMAR SINGH HON’BLE MR. JUSTICE BISWAJIT PALIT Order 12/11/2024 Petitioner is the widow of one Mirendra Marak, Helper who was dismissed from service by order dated 07. 11. 2005 passed by Chief Engineer, PWD (R&B), Tripura, Agartala on charges of unauthorized absence without intimation to the authority since 14. 02. 2005.

Though the instant dismissal order was challenged after much delay in WP(C) No. 559/2024, but learned counsel points out from para 8 of the impugned judgment that the learned Writ Court has committed an error on the face of record by holding that the order of dismissal passed against the husband of the petitioner way back in 2005 has remained unchallenged till date. We have heard learned counsel for the petitioner and perused the writ records which also contains a prayer for quashing the order of dismissal dated 07. 11. 2005 [Annexure-C to the writ petition]. Since there is an error apparent on the face of record in the impugned judgment, petitioner should approach the learned Court in review jurisdiction. With these observations, the instant writ appeal is disposed of with the aforesaid liberty.
