Judgment text
Item No. 32 IN THE HIGH COURT OF MANIPUR AT IMPHAL WP(C) No. 607 of 2023 W. Thapa Maring ….. Petitioner/s - Versus – State of Manipur & 2 Ors. .... Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 28. 08. 2024 [1] Present Mr. S. Worthing, learned counsel for the petitioner and Mrs. RK. Emily, learned Dy. G. A. for the State respondent. [2] The service of the petitioner was kept under suspension for involvement in the FIR case and he approached this Court for setting aside the suspension order dated 18. 11. 2022. [3] In the counter affidavit filed by the respondents, it is submitted that the petitioner retired from service on attaining the age of superannuation with effect from 28. 02. 2023. Since, the main prayer for quashing the suspension order by the subsequent event of superannuation, the relief prayed for in the writ petition has become infructuous. It is submitted that writ petition may be closed. [4] Mr. S.
Worthing, learned counsel for the petitioner, submits that in terms of the letter dated 08. 09. 2023 written by the Director (Transport), Manipur for provisional pension, the petitioner has already submitted necessary paper for provisional pension. If the same is in order, provisional pension may be released as per rule. [5] With the subsequent event of superannuation of the petitioner, this Court is of the opinion that the relief prayed for in the present petition has become infructuous. [6] Accordingly, writ petition is closed. JUDGE Kh. Joshua Maring Digitally signed by KH. JOSHUA KH. JOSHUA MARING MARING Date: 2024. 08. 30 09:44:27 +05'30'
