Turi aged about 17 years, s/o Gulabi Turi,, resident of village – Koanarwak, PO – Malda, PS – Gawan, District – Giridih (Jharkhand). … .. Appellant Versus 1. The State of Jharkhand. 2. Mother of victim (x). … .. Respondents ----- CORAM: HON'BLE MR. JUSTICE SANJAY PRASAD ----- For the Appellant : Mr. Sujit Kr. Singh, Advocate [Thr:- VC] For the State : Mrs. Lilly Sahay, APP For the Informant : None st Order No. 08/01 December 2025 1. Mr. Sujit Kr. Singh, learned counsel for the appellant has appeared through video conferencing and the quality of audio and video of video conferencing is proper. Mrs. Lilly Sahay, learned A. P. P. is appearing on behalf of the State. However, despite service of notice issued upon her through her guardian vide order dated 20. 08. 2025 passed by this Court, none appears on behalf of the Informant-victim girl. 2.
As per FIR lodged by the mother of the victim girl on 07. 05. 2024, it has been alleged that the appellant-Ravi Turi and another accused Pappu Turi (who are the juvenile), are proposed to be friends and they had physically exploited her daughter (name not disclosed in light of the judgment rendered in the case of Nipun Saxena and Anr. Versus Union of India reported in (2019) 2 SCC 703 and also vide Notification No. 23/2023/R&S/JHC dated 20. 12. 2023 issued by the High Court of Jharkhand), for the last one year and threatened her because one co-accused Pappu Turi had taken an indecent video of her for establishing physical relationship from the appellant Ravi Turi and they were blackmailing her daughter continuously for around six months for establishing physical relationship with her. When her daughter refused to establish physical relationship, then her indecent photograph has been made viral on Facebook by the co-accused Pappu Turi.
It is alleged that the appellant Ravi Turi is also asking his daughter to fled-away with him to Rajasthan although several girls have been taken to Rajasthan by the mother of the appellant Ravi Turi. 3. Learned counsel for the appellant has submitted that the impugned order passed by the learned Court is illegal, arbitrary and not sustainable in law. It is further submitted that the appellant is innocent and has committed no offence. It is submitted that although there is allegation of establishing physical relationship in the FIR upon the appellant, but the victim girl during her statement recorded under Section 164 of the Cr. P. C. , has not stated this fact. It is further submitted that the video of the victim girl has been made viral by the co-accused Pappu Turi and not by this appellant. It is further submitted that the appellant is a juvenile and he is in custody since 31. 05. 2024 i. e. for around one and half years. Hence, he may be enlarged on bail. 4.
On the other hand, learned A. P. P. opposed the prayer for bail of the appellant and has submitted that there is direct allegation against the appellant for establishing physical relationship with the victim girl and for giving her indecent photographs to his friend Pappu Turi and who had made viral her indecent photographs on Facebook. It is submitted that the victim is aged around 16 to 17 years by the Medical Officer. Hence, the prayer for bail of the appellant may be rejected. 5. Perused the FIR, Case Diary and statement of the victim girl recorded under Section 164 of the Cr. P. C. and also statement of the victim girl recorded before Child Welfare Committee, Giridih. 6. It appears from the FIR that there is direct allegation against the appellant for establishing physical relationship with the victim girl at the time of her taking bath and for blackmailing her on the basis of such photographs.
It also appears that the statement of the victim girl was recorded by the Child Welfare Committee, Giridih on 09. 05. 2024 and she has fully supported the case by stating that whenever her parents used to go outside for work, the appellant had established physical relationship with her. She has also stated that whenever her marriage was fixed, the said photographs were sent to the said family due to which her marriage could not be settled. It also appears from the statement of the victim girl recorded under Section 164 of the Cr. P. C. that she has fully supported her case that appellant has forcibly established physical relationship with her, from which one video was prepared and later on the same was made viral. 7. It appears that the confessional statement of the juvenile was recorded at Para no. 49 of the case diary, in which, he has stated that he has established physical relationship with the victim girl and has prepared one indecent video and had taken photograph of her.
Later on, even whenever the marriage of the victim girl was fixed, he sent the said photographs due to which the marriage could not be settled. 8. It also appears that the witness i. e. the victim girl herself (name not disclosed in light of the judgment rendered in the case of Nipun Saxena and Anr. Versus Union of India reported in (2019) 2 SCC 703 and also vide Notification No. 23/2023/R&S/JHC dated 20. 12. 2023 issued by the High Court of Jharkhand), and also from the statements of her father, grand-mother, aunt and uncle were recorded at Paragraph Nos. 9, 10, 11 and 12 of the case diary have supported the prosecution case against the appellant. 9. It also appears that during investigation, the Investigating Officer has found allegation true against the appellant and had submitted a charge-sheet under Sections 376(2) (n) / 120(B) / 34 of the Indian Penal Code along with Sections 66(E) / 67 /67(A) / 67(B) of the I. T. Act and Section 4 / 8 of the POCSO, Act. 10.
This Court has also perused the written statement of the victim girl recorded under Section 164 of the Cr. P. C. but in view of the allegations made in the FIR and the statement of the victim girl recorded before the Child Welfare Committee, Giridih, this Court is not inclined to enlarge the appellant on bail. 11. Accordingly, this Criminal Appeal No. 688 of 2025, is hereby dismissed. (Sanjay Prasad, J. ) Dated 01. 12. 2025 Aditi
