Learned Additional Government Advocate, on instructions, submits that pursuant to the impugned notice, a First Information Report has now been registered and the petitioner is arrayed as an accused therein. It is therefore contended that the impugned police notice, which is called in - 3 - WP No. 13170 of 2026 question in the present writ petition, does not survive for consideration and has, in effect, been rendered infructuous. 3.

Recording the aforesaid submission, this Court finds that the grievance projected by the petitioner stems from an alleged misuse of police machinery by respondent No. 3 in relation to a dispute arising out of a Joint Development Agreement, which, prima facie, bears the trappings of a commercial dispute. In that view of the matter, once an FIR is registered, the petitioner is relegated to avail such remedies as are available in law, in accordance with the procedure prescribed. 4. In the light of the submission made by the learned Additional Government Advocate that the impugned notice will not be pursued in view of the registration of the FIR, nothing further survives for consideration in the present writ petition. Accordingly, the writ petition stands disposed of. Sd/- (SACHIN SHANKAR MAGADUM) JUDGE HDK/List No. : 1 Sl No. : 17
