The present Appeal has been filed by the appellant-claimant to enhance the amount awarded by learned Motor Accident Claims Tribunal / IInd Additional District Judge, Nainital in Motor Accident Claim Petition No. 172 of 2013, by which the learned Tribunal has awarded a total sum of Rs. 59,000/- as a compensation with 7% interest per annum from the date of petition till its actual realisation. 2. Heard Mr. Zafar Siddiqui, learned counsel for the appellant and Mr. Pulak Agarwal, learned counsel for the respondent no. 3. 3.
Learned counsel for both the parties submitted that parties have settled their disputes and as per the compromise, a sum of Rs. 59,000/- has been deposited before the Tribunal and the Insurance Company-respondent no. 3 will pay enhanced amount of Rs. 1,00,000/- (Rupees One Lakh) to the claimant within 45 days from today. 4. Both the parties have requested to decide the present appeal in terms of the Compromise. 5. The Compromise is verified. 6. The present Appeal (AO No. 136 of 2016) is decided in terms of the Compromise. 7.
