Criminal Miscellaneous Bail Application No. 8238/2026 CNR: RJHC010593082026 | URN: CRLMB / 17885U / 2026 Sheraram S/o Shri Ransaram, Aged About 30 Years, R/o Kyari, P. s. Bekariya, District Udaipur, Rajasthan (Presently Lodged In Sub Jail Sanchore ) ----Petitioner Versus State Of Rajasthan, Through Public Prosecutor ----Respondent For Petitioner(s) : Mr. B. S. Rathore For Respondent(s) : Mr. H. S. Jodha, PP HON'BLE MR. JUSTICE SANDEEP SHAH Order 07/08/2026 1.
The applicants have filed the present bail applications under Section 483 of BNSS being aggrieved against the orders dated 06. 06. 2026 passed by the learned Additional Sessions Judge, Sanchore, District Jalore, in Criminal Miscellaneous Case Nos. 300/2026 (Bharmaram vs. State of Rajasthan) & 301/2026 (Sheraram vs. State of Rajasthan) respectively, whereby the bail [2026:RJ-JP:37536] (2 of 3) [CRLMB-8239/2026] applications filed by the accused-applicants under Section 483 of B. N. S. S. were rejected. The accused-applicants are behind the bars, pursuant to the F. I. R. No. 14/2026 registered at Police Station Sarwana, District Jalore, for the offences punishable under Sections 331(4) & 305(a) of BNS. 2. Learned counsel for the applicants submits that the offences alleged are triable by Court of Magistrate. He further submits that though the applicants are having criminal antecedents, however, the charge-sheet has already been filed.
He further submits that the applicants are behind the bars since 06. 03. 2026 and the trial of the case is likely to take a sufficiently long time to conclude. He, therefore, implores this Court to allow the present bail applications. 3. Per contra, learned Public Prosecutor opposes the bail applications and submits that considering the nature of the offences, the applicants do not deserve to be enlarged on bail. 4. Heard learned counsel for the applicants as well as the learned Public Prosecutor and perused the material available on record. 5. Having considered the arguments advanced by both the sides and having regard to the facts and circumstances of the case, more particularly the facts that of the offences alleged are triable by Court of Magistrate, the applicants are behind the bars since 06. 03.
2026, though the applicants are having criminal antecedents of identical nature, however, considering the fact that the charge-sheet has already been filed and no recovery is to be made from the applicants, and also, while laying stress upon the fact that the offences alleged are triable by Court of Magistrate, [2026:RJ-JP:37536] (3 of 3) [CRLMB-8239/2026] and the trial is likely to take a sufficiently long time to conclude, this Court prima facie finds it to be a fit case to enlarge the accused-applicants on bail. 6. Thus, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the accused-applicants on bail. 7. Consequently, the bail applications under Section 483 B. N. S. S. are allowed. It is ordered that the accused-applicants; (1) Bharmaram S/o Shri Soparam & (2) Sheraram S/o Shri Ransaram arrested in connection with F. I. R. No.
14/2026 registered at Police Station Sarwana, District Jalore, shall be released on bail, if not wanted in any other case, provided each of them furnishes a personal bond of Rs. 50,000/- and two sureties of Rs. 25,000/- each, to the satisfaction of learned Trial Court, for their appearance before that Court on each & every date of hearing and whenever called upon to do so till completion of the trial. 8. It is further, made clear that findings recorded/observations made herein-above are for limited purposes of adjudication of bail applications and the same shall not prejudice the trial of the case in any manner.
