IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6064 of 2020 Chandrakant Ojha … ... Petitioner Versus The State of Jharkhand … … Opp. Party -------- CORAM: HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY -------- For the Petitioners : Mr. Binod Singh, Advocate For the State : A. P. P. --------th Order No. 02: Dated: 4 December, 2020 Heard the parties. So far as the defect nos. 3, 4, 5(e) & 9(vii) are concerned learned counsel for the petitioner undertakes to remove the same once the situation normalizes. As regards the rest defects are concerned, the same are ignored. The petitioner apprehends his arrest in connection with Palamu Mahila P. S. Case No. 07 of 2020. The marriage of the informant was solemnized with the petitioner on 23. 11. 2017. It has been alleged that after her marriage she was subjected to torture by the petitioner as well as his entire family members for non-fulfillment of the demand of dowry.
The petitioner appears to be the husband of the informant and the allegation against him is general and omnibus in nature as per the FIR. Though a mention has been made in the impugned order about some of the independent witnesses stating commission of assault upon the informant the victim does not specifically allege an act of assault and demand of dowry as against the petitioner. On consideration of the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner, above named, is directed to surrender in the court below within a period of four weeks from today and in that event, he will be enlarged on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Palamau at Daltonganj, in connection with Palamu Mahila P. S. Case No.
07 of 2020, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. This application stands allowed. (Rongon Mukhopadhyay, J. ) MM
