10-12-2025 2/3 CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 3 10-12-2025 Heard learned counsel for the petitioners and learned APP for the State. 2. All the three petitioners are in custody in a case registered for the offences punishable under Sections 310(2) & 126(2) of BNS, 2023. 3. As per allegation in the FIR, while the informant was returning to his house by his motorcycle, three unknown accused persons came and assaulted the informant and took away his belongings on the point of pistol. 4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He next submits that the petitioners have been arrested only on the basis of suspicion and nothing has been recovered from the possession of the petitioners. He next submits that similarly situated co-accused person has already been granted bail by a Coordinate Bench of this Court passed in Cr. Misc No. 72290 of 2025. The Petitioners are in custody since 10. 07. 2025.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner. 6. Considering the facts that similarly situated Co-accused person has already been granted regular bail by a Patna High Court CR. MISC. No. 68791 of 2025(3) dt. 10-12-2025 3/3 Coordinate Bench of this Court, so let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to be satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.
