JUSTICE SANJAY DHAR, JUDGE ORDER Learned counsel for the petitioners has submitted that after passing of the order dated 31. 10. 2020 made by Special Judge (Principal Sessions Judge, Samba), whereby the bail application of the petitioners herein was rejected, the challan stands filed before the learned trial Court on 25. 11. 2020. Learned counsel has further submitted that after the rejection of the bail applications of the petitioners, learned trial Court has, vide its order dated 11. 12. 2020, enlarged the co-accused on bail.
In view of these changed circumstances, learned counsel for the petitioners seeks permission of this Court to withdraw this petition with liberty to approach the trial Court by filing a fresh application. Leave and liberty is granted and the petition is disposed of as having been withdrawn. 2 Bail App No. 257/2020 It is provided that in case the petitioner approaches the learned trial Court with the fresh bail applications, the same shall be considered by the learned trial Court in view of the changed circumstances mentioned herein before.
