JUSTICE DEVENDRA KACHHAWAHA Order 18/12/2020 The corpus Mst.

‘P’ has been produced before us from the Nari Niketan, Jodhpur, where we had sent her by order dated 17. 12. 2020 so as to give her time for pressure-free contemplation. Upon conferring with the corpus, with full confidence at her command, she stated that she had got engaged to the petitioner, but now she is not inclined to go and live with him and would rather be happy staying at her father’s house. She bluntly (2 of 2) [HC-146/2020] refused the offer to accept the amount of per-emptory cost of Rs. 50,000/- deposited by the petitioner in terms of the order dated 18. 11. 2020. In view of the facts noticed above and as the corpus is apparently not under any kind of illegal detention, we set her at liberty to proceed as per her desire. From the per-emptory cost of Rs. 50,000/- deposited by the petitioner, a sum of Rs. 10,000/-shall be appropriated in the funds of the Rajasthan State Legal Services Authority and the remaining amount of Rs. 40,000/- shall be reimbursed to the petitioner.

The habeas corpus petition is disposed of, accordingly. Rule is discharged. (DEVENDRA KACHHAWAHA),J (SANDEEP MEHTA),J 5-Pramod/-
