HIGH COURT OF TRIPURA AGARTALA Crl. Petn. No. 39/2020 Sri Jahar Saha ----Petitioner(s) Versus The State of Tripura -----Respondent(s) For Petitioner(s) : Mr. Rajib Saha, Advocate. For Respondent(s) : Mr. Samrat Ghosh, Addl. P. P. HON’BLE THE CHIEF JUSTICE MR. AKIL KURESHI Order 25/11/2020 Petitioner is the owner of a Maruti Alto car bearing registration No. TR-06-B-0390. The vehicle has been seized in connection with a criminal complaint bearing case No. 73 of 2019. According to the FIR, on 04. 11. 2019 three young persons were found talking in a public place in suspicious circumstances. When challenged they tried to flee upon which they were nabbed and searched on their persons and the vehicle was carried out. According to the first information report, a small quantity of Heroin was found from one of them. Learned counsel for the petitioner submitted that the narcotic drug found was of small quantity. In any case, it was not seized from the vehicle.

It was allegedly found from the pocket of one of the persons standing outside. Considering such circumstances, in my opinion, the vehicle should be released, subject to certain conditions. The respondent shall release the vehicle in question after drawing proper panchnama and on the condition that the petitioner shall produce the same before the concerned Court as and when directed. He shall not sell, transfer or create any encumbrance on the vehicle till the trial is over. Rule is made absolute. Petition is disposed of accordingly. (AKIL KURESHI), CJ Pulak
