Judgment text

IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6294 of 2020 --- 1. Kailash Gope 2. Tikender Yadav 3. Lallu Yadav @ Lalu Yadav 4. Suman Kumari @ Suma Kumari 5. Saro Devi … … Petitioners Versus The State of Jharkhand … … Opposite Party --- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioners : Mr. Shailendra Jit, Advocate For the Opposite Party : Mr. Pradeep Kumar Verma, A. P. P. --- 2/17. 12. 2020 Heard the parties. Defects as pointed out by the office are ignored. The petitioners are apprehending their arrest in connection with Barkagaon P. S. Case No. 78 of 2020. It has been alleged that the accused persons had assaulted the informant by branding her a witch. Her family members were also assaulted. The petitioner no. 1 had also lodged a case being Barkagaon P. S. Case No. 77 of 2020 against the informant and his family members. It appears that the petitioner no. 1 and 3 had also sustained injury on account of the assault committed upon them.

It therefore seems that there was a free fight between the parties which led to filing of case and counter case. Even otherwise the allegations are general and omnibus in nature, so far as the petitioners are concerned. On consideration of the above, I am inclined to extend the privilege of anticipatory bail to the petitioners. Accordingly, the petitioners above named are directed to surrender in the court below within four weeks and pray for bail, and in that event, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned S. D. J. M. , Hazaribag in connection with Barkagaon P. S. Case No. 78 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. This application stands allowed. (Rongon Mukhopadhyay, J) R. Shekhar Cp 3
