NOBIN SINGH O R D E R 25-08-2020 Heard Smt. H. Bisheshori, learned counsel appearing for the petitioner and Shri Niranjan Sanasam, learned Government Advocate appearing for the respondents. Pursuant to the notice dated 11-08-2020 issued by this court, it has been submitted by Shri Niranjan Sanasam, learned Government Advocate on instruction that in the case registered under FIR No. 136(17)2020 PRT P. S. u/s 325/353/307/507 IPC, police has already started investigation and during the course of the investigation, the statements of the complainant as well as the accused have been recorded. It has been further submitted by him that the accused was arrested by the police but he was released on bail because of the order passed by the Session Judge, Imphal East.
Further it has also been submitted by him that in the investigation, substantial progress has been made and accordingly, the instant writ petition can be disposed of to which, the learned counsel appearing for the petitioner has submitted that the complainant namely, the petitioner herein has been threatened by his wife at the instigation of the accused for withdrawal of the case. Be that as it may, since the case is being investigated by the police progressively, the role of this court is limited and accordingly, the writ petition stands disposed of with the direction that the police shall try to W. P. (C) No. 444 of 2020 Contd…/-complete the investigation as quickly as possible as per law preferably within 6 (six) weeks from today. If the petitioner is aggrieved with the manner in which the investigation is being carried out by the police, he is at liberty to approach the appropriate Judicial Magistrate before whom the case is pending.
