Digitally signed by KABORAMBAKABORAMBAM M SANDEEP SANDEEP SINGH Date: 2024. 10. 16 SINGH Item No. 41 14:52:44 +05'30' IN THE HIGH COURT OF MANIPUR AT IMPHAL Tr. P. (C) No. 3 of 2023 K. Adani Petitioner Vs. Kashipri Besii; & Ors. Respondents BEFORE HON’BLE THE CHIEF JUSTICE MR. SIDDHARTH MRIDUL ORDER 10. 10. 2024 Mr. N. Umakanta, learned senior counsel, appears on behalf of the petitioner; and Mr. Julius Riamei, learned counsel, appears on behalf of the respondents. The present application has been instituted on behalf of Mr. K. Adani, the petitioner, seeking transfer of Original (Declaratory) Suit No. 4 of 2022 (Kashipri Besii and 5 others - Vs. - K. Adani), pending before the Court of Civil Judge (Sr. Division) Senapati, presently at Kangpokpi to any other Court of the Civil Judge, (Sr. Division) in Imphal city.
The petitioner who is the sole defendant in the aforementioned suit, seeks transfer on the ground that it is not possible for his counsel, owing to the prevailing situation in Manipur, to attend the District Court at Kangpokpi where the Court of Civil Judge (Sr. Division) Senapati is presently functioning. It is observed that the Court to which transfer has been sought by the petitioner, does not have territorial jurisdiction over the subject matter of the dispute in the said Original (Declaratory) Suit No. 4 of 2022. Even otherwise, Tr. P. (C) No. 3 of 2023 Page 1 currently, facilities for electronic filing as well as appearing through video conferencing are operational at the concerned Court in Kangpokpi. Resultantly, the present transfer petition is dismissed whilst permitting the petitioner and or to his counsel to act, appear and plead before the Court of Civil Judge (Sr. Division) functioning at Kangpokpi electronically.
In the event of any difficulty in so doing, the petitioner is at liberty to file an appropriate application before the Court concerned. No further directions are prayed for. The present petition is accordingly disposed of. CHIEF JUSTICE Sandeep Tr. P. (C) No. 3 of 2023 Page 2
