JUSTICE AMBUJ NATH ------ For the Petitioner : Mr. Karan Kaushik, Advocate For the State : Mr. P. D. Agrawal, Spl. P. P. ------ 03/11. 12. 2024 Heard the parties. 2. The petitioner has been made accused in connection with S. T. Case No. 532/2023 arising out of Hariharganj P. S. Case No. 48/2023 corresponding to G. R. Case No. 1442/2023, for the offences registered under Sections 302/34 and 120B of the I. P. C. , pending in the Court of Ms. Aisha Khan, learned A. S. J. -VIII, Palamau at Daltonganj. 3. Bail application of the petitioner was earlier rejected by this Court in B. A. No. 8702/2023 vide order dated 06. 12. 2023. 4. On 26. 04. 2023 at about 7:00 P. M.
, husband of the informant had gone to Akhauni Village and thereafter he went missing. On 27. 04. 2023, his dead body was recovered from a place near Harahi River. Suspicion was raised upon the petitioner and co-accused that they might have committed murder of the deceased as they had quarreled with the deceased prior to the occurrence. 5. It appears that on confession of the petitioner and co-accused, a blood stained lathi used in committing murder of the deceased, was recovered. 6. Considering the aforesaid facts and the fact that trial of this case is under progress, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner stands rejected. 7. Learned Trial Court shall expedite the trial and preferably conclude the same as shortly as possible or within six months from the next date of trial. (Ambuj Nath, J. ) Rahul/-
