[2026:RJ-JP:36199] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 3774/2026 CNR: RJHC010297932026 | URN: CRLMB / 8488U / 2026 Abdul Ganni Alias Ganni Khan S/o Nijamuddin, Aged About 35 Years, Resident Of Junejo Ki Dhani, Gaji Magra, Police Station Phalodi, District Phalodi Rajasthan Date Of Arrest 11-03-2026 . At Present Lodged In District Jail, District Bikaner. ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ghever Ram For Respondent(s) : Mr. Hanuman Prajapati, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 03/08/2026 This application for bail under Section 483 BNSS (439 Cr. P. C. ) has been filed by the petitioner who has been arrested in connection with F. I. R. No. 38/2026, registered at Police Station Mukta Prasad Nagar, District Bikaner, for offences under Section 318(4), 316(2) of BNS.

Learned counsel for the petitioner submits that the offences alleged to have been committed by the petitioner are triable by the Court of Magistrate and after investigation, charge-sheet has been filed. Learned counsel further submits that the petitioner has been in judicial custody since the date of his arrest and that the trial is likely to take considerable time to conclude. Therefore, it is prayed that the benefit of bail be granted to the accused-petitioner. [2026:RJ-JP:36199] (2 of 2) [CRLMB-3774/2026] Per contra, learned Public Prosecutor has opposed the bail application. Heard learned counsel for the parties and perused the material available on record. Further, after investigation, charge-sheet has been filed.

This Court has considered the facts and circumstances of the case; the alleged offences are triable by a Magistrate; keeping in view of the fact that conclusion of the trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS. Consequently, the bail application under Section 483 BNSS (439 Cr. P. C. ) is allowed. It is ordered that the accused-petitioner Abdul Ganni @ Ganni Khan S/o Nijamuddin arrested in connection with aforesaid FIR, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs. 50,000/- and two sureties of Rs.

25,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial. (BALJINDER SINGH SANDHU),J 152/Jatin Kumar
