IN THE HIGH COURT OF KERALA AT ERNAKULAM PRESENT THE HONOURABLE MR. JUSTICE DEVAN RAMACHANDRAN TH TUESDAY, THE 9 DAY OF JANUARY 2024 / 19TH POUSHA, 1945 WP(C) NO. 363 OF 2024 PETITIONER: 1 MARY RONA D SILVA AGED 16 YEARS D/O SUNNY PEXON D SILVA , REP BY LEGAL GUARDIAN SUNNY PEXON D SILVA , POONTHEDATH PARAMBIL, BOSCO NAGAR PALLURUTHY, ERNAKULAM, PIN - 682006 2 VISHNU C. KIRANLAL SAILAKSHMI MENON RESPONDENTS: 1 STATE OF KERALA REPRESENTED BY THE PRINCIPAL SECRETARY TO GOVERNMENT, GENERAL EDUCATION DEPARTMENT, SECRETARIAT, THIRUVANANTHAPURAM, PIN - 695001 2 THE GENERAL CONVENER KERALA SCHOOL KALOLSAVAM 2022-2023, (THE DIRECTOR OF GENERAL EDUCATION, JAGATHY P. O. , THIRUVANANTHAPURAM, PIN - 695014 3 THE CHAIRMAN, APPEAL COMMITTEE KERALA SCHOOL KALOLSAVAM 2022-2023, OFFICE OF THE DISTRICT EDUCATIONAL OFFICER, ERNAKULAM, PIN - 682011 SMT.
VIDYA KURIAKOSE, GP THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 09. 01. 2024, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: JUDGMENT This is a case where the petitioners have approached this Court, seeking permission to participate in the State Level School Kalolsavam, conceding that they and their team have not participated in the District Level Kalolsavam. 2. The learned counsel for the petitioners, explained that the petitioners did not obtain Rank No. 1 in the Sub Revenue District Kalolsavam and that though they preferred appeals before the Appellate Committee, they did not receive the Appellate order in time, so as to participate in the District Level School Kalolsavam. He, therefore, prayed that they be allowed to participate in the State School Kalolsavam. 3.
Before I proceed further, I must record that this Court had not granted any interim order to the petitioners in this writ petition; and consequently, therefore, they have not been able to participate in the State School Kalolsavam, which has now been completed on 08. 01. 2024. 4. That apart, one fails to understand how the petitioners can claim a right to participate in the State School Kalolsavam, without having participated in the District Kalolsavam; and their explanation is tenuous because, even if they had not received the appellate order at the Sub Revenue District Kalolsavam level, they could have approached this Court - as has been done by various others - for the purpose of participating in the District School Kalolsavam. Since they did not do so, obviously, they have forfeited any right to claim to participate in the State Kalolsavam. In the afore circumstances, this writ petition is dismissed.
