[2026:RJ-JP:36845] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR S. B. Criminal Miscellaneous Bail Application No. 7673/2026 CNR: RJHC010566302026 | URN: CRLMB / 16893U / 2026 Naresh Alias Nareshram Alias Nainaram S/o Ganesharam, Aged About 40 Years, R/o Raydhanu, P. s Sadar Nagaur District Nagaur (Lodged In Dist. Jail Bikaner) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Mangilal Vishnoi For Respondent(s) : Mr. Hanuman Prajapati & Mr. Om Prakash Choudhary, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 05/08/2026 1. This application for bail under Section 483 BNSS has been filed by the petitioner, who has been arrested in connection with F. I. R. No. 170/2026 registered at Police Station Panchu, District Bikaner for the offence under Sections 8/21, 29 of NDPS Act. 2. Counsel for the petitioner contends that petitioner is quite an innocent person. He has falsely been implicated in this case. Charge-sheet has already been filed.
The allegedly recovered contraband substance (27. 62 Grams of Smack) is below commercial quantity, as prescribed under the NDPS Act and, as such, rigour of Section 37 of the NDPS Act of not releasing the accused on bail is not attracted. Furthermore, recovery has been affected from Deepa Ram. It is stated that nothing has been recovered from the conscious possession of petitioner and [2026:RJ-JP:36845] (2 of 3) [CRLMB-7673/2026] petitioner has been enroped in this case on the ground of statement of co-caused Deepa Ram. It is further stated that co-accused Deepa Ram has already been enlarged on bail by Co-ordinate Bench of this Court on 02. 06. 2026. So far as pending cases against the petitioner is concerned, he has not been convicted in cases under NDPS Act and rest of the cases are under IPC offences. The trial of case is likely to take a long time, therefore, benefit of bail may be granted to the petitioner. 3.
Per contra, learned Public Prosecutor opposed application, however, is not in a position to refute the aforesaid submissions. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the rival submissions, facts and circumstances of the case; the alleged recovery is below commercial quantity; charge-sheet has already been filed; petitioner has not been convicted in similar cases of NDPS Act and in rest of the cases are under IPC offences; conclusion of trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioner fleeing away from justice in case he is enlarged on bail; but, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the petitioner under Section 483 of BNSS. 6. Consequently, the bail application under Section 483 BNSS is allowed. It is ordered that the accused-petitioner Govardhan Lal S/o Mangi Lal arrested in connection with F. I.
R. No. 170/2026 registered at Police Station Panchu, District Bikaner, shall be released on bail, if not wanted in any other case, provided he [2026:RJ-JP:36845] (3 of 3) [CRLMB-7673/2026] furnishes a personal bond of Rs. 1,00,000/- and two sureties of Rs. 50,000/- each, to the satisfaction of learned trial court for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.
