Petitioner has been made accused in connection with Deodand P. S. Case No. 23 of 2025 for the offence registered under Section 103(1) of the B. N. S. , 2023, pending in the Court of learned Sub-Divisional Judicial Magistrate, Godda. 3. In the evening of 03. 06. 2025, the son of the informant, namely, Babu Lal Murmu left his house and thereafter he went missing. At about 12. 00 am in the night, he was found lying in injured condition in the village.
The informant took him to hospital where he was declared brought dead. 4. The statement of one independent witness, namely, Sushil Baski has been recorded during the course of investigation. He has stated that he had seen the petitioner committing the murder of the deceased. 5. It appears that on the basis of confession of this petitioner, the axe, which was used in committing the murder of the deceased, was recovered. 6. Learned counsel appearing for the petitioner has submitted that the seizure list regarding recovery of axe does not bear the signature of the petitioner. 7. Considering the fact that one independent witness has stated that the petitioner had committed the murder of the deceased, I am not inclined to enlarge the petitioner on bail.
