IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 3571 of 2020 --- Binod Kumar Ravi @ Vinod Kumar Ravi … … Petitioner Versus The State of Jharkhand … … Opposite Party --- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioner : Mr. Surendra Prasad Sinha, Advocate For the Opposite Party : Mrs. Priya Shrestha, A. P. P. --- 2/15. 12. 2020 Heard the parties. So far as defect no. 3, 4, 5 (e), 9 (iii) & (iv) are concerned, learned counsel for the petitioner undertakes to remove the same, once the situation normalizes. As regards, the rest defects are concerned, the same are ignored. The petitioner is apprehending his arrest in connection with Hariharganj P. S. Case No. 4 of 2019. It has been alleged that the accused persons had disbursed the government funds to several persons on improper verification. The petitioner appears to be the Panchayat Sevak in Dema Panchayat.
Submission has been advanced that in the FIR, nothing has been stated about the amount which was disbursed. It appears that an inquiry was conducted and the allegations were found to be true. It appears that some beneficiaries were shown twice and double payments were made to them. Since the petitioner was found guilty in the inquiry, which has been conducted by the department, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, this application stands rejected. However, if the petitioner surrenders before the court below within a period of 3 weeks and prays for bail, the learned counsel below shall endeavour to dispose of the bail application expeditiously and without being prejudiced by this order of rejection.
