HIGH COURT OF TRIPURA AGARTALA A. B. 130 /2020 Manik Das ----Petitioner(s) Versus The State of Tripura ----Respondent(s) For Petitioner(s) : Mr. D. Sarkar, Advocate For Respondent(s) : Mr. Ratan Datta, PP HON’BLE MR. JUSTICE ARINDAM LODH Order 17/11/2020 Heard Mr. D. Sarkar, learned counsel appearing for the petitioner as well as Mr. Ratan Datta, learned PP appearing for the State-respondent. This is an application filed under section 438 Cr. P. C. for granting anticipatory bail to the petitioner in connection with Kalamchaura PS case No. 23 of 2020 under Sections 20(b)(ii)(c)/25/29 of the NDPS Act. The instant case was registered by the Officer-in-Charge of Kalamchaura PS on the basis of a complaint lodged by one police officer for seizing commercial quantity of dry ganjas from the house of the accused-petitioner. Mr. Sarkar, learned counsel has submitted that the accused-petitioner is innocent and has no connection with the trading of any contraband article.

He has further submitted that the house where from the contraband articles were seized belongs to his deceased father and he does not reside in that house for the last two years. Mr. Ratan Datta, learned PP has produced the case diary and has submitted that when the raid and search was conducted, the I. O. found so many persons who were engaged in packing dry ganjas. I have perused the case diary. From the case diary, it is transpired that one of the labourers has divulged that they were working under the accused petitioner, namely, Manik Das. I have considered the submission of the learned counsel appearing for the parties as well as the statement of the witnesses found in the case diary. Having considering the materials, as surfaced in the case diary, I do not find any merit in the present application. Accordingly, the instant application stands dismissed. JUDGE Saikat
