C. , seeking pre-arrest bail by the petitioner, namely, Dr. Momin Sheikh in connection with Sipajhar PS Case No. 621/2020, registered under Sections 109/306/34 of IPC. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who has produced the case diary and perused the same.
The brother of the deceased lodged the FIR to the effect that his brother namely, Nagen Saikia committed suicide because of the fact that his wife Dhanada deka had some illicit relation with other persons and the entire allegation goes against the wife of the said person. Page No. # 2/2 The witnesses so far recorded has revealed that they have some doubt with the wife of the deceased regarding some illicit relationship with the present petitioner. IO has submitted that complicity of the accused petitioner is not found with the offence alleged. In those circumstances, custodial detention of the accused person appears to be not warranted. Accordingly the interim bail granted to the petitioner is hereby made absolute. In terms of the above, this bail application stands disposed of. Return the case diary. JUDGE Comparing Assistant
