HON'BLE MR. JUSTICE VINIT KUMAR MATHUR Order 30/01/2025 1. Heard learned counsel for the petitioner. 2. Learned counsel for the petitioner, after having attempted to argue the matters at some length, seeks permission to withdraw the present writ petitions with liberty to file appeal(s) against the order impugned. 3. Learned counsel for the petitioner submits that since the writ petitions are pending consideration before this Court from last almost one year and the learned trial Court has granted interim protection, therefore, the petitioner’s right may be protected by passing an interim order for a reasonable time till the petitioners approach the Appellate Authority. 4. Learned counsel for the respondents is not in a position to refute the submissions made by the learned counsel for the petitioner. 5.
In view of the submissions so made before this Court, the present writ petitions are dismissed as withdrawn with liberty to the petitioner to file appeal(s) before the Appellate Authority. It is [2025:RJ-JD:5989] (3 of 3) [CW-1669/2024] made clear that the Appellate Authority shall consider the time spent in prosecuting the writ proceedings before this Court while examining the delay caused in filing the appeal. 6. The petitioner shall file appeal(s) within a period of two weeks from today and till 14. 02. 2025, both the parties shall maintain status quo as it exists today with respect to the property in question.
