Item No. 2 IN THE HIGH COURT OF MANIPUR AT IMPHAL WP(C) No. 347 of 2020 Hajarimayum Joykumar Sharma .... Petitioners -Versus- State of Manipur & 3 Ors. .... Respondents BEFORE HON’BLE MR. JUSTICE LANUSUNGKUM JAMIR Order 08. 07. 2020 Heard Mr. D. Julius Riamei, learned counsel for the petitioner. Also heard Mr. Sukumar, learned G. A. appearing on behalf of respondent No. 1 and Mr. Y. Nirmolchand, learned senior counsel for the respondent Nos. 2 & 3. Considering the nature of Order being passed today, no notice is served on the respondent No. 4. The petitioner was appointed as Grade – IV (Peon) on 30. 01. 1995 in the Imphal Municipal Corporation. The next promotional post of the petitioner is to the post of LDC. The petitioner has completed 25 (twenty five) years in the grade of Peon. However, till date, no promotion has been given to the petitioner. However, by an Order dated 21. 10. 2019, the respondent No.

4 was given promotion to the post of LDC by ignoring the case of the petitioner. The Imphal Municipal Corporation also issued a seniority list of Peon as on 06. 02. 2020 wherein, the name of the petitioner appears at Serial No. 16 and the respondent No. 4 at Serial No. 22. Being aggrieved with the supersession of the petitioner by the respondent No. 4 to the post of LDC, the petitioner made a Representation dated 23. 03. 2020 before the Municipal Commissioner, Imphal Municipal Corporation. The said representation is still pending for disposal before the respondent No. 3. Accordingly, this writ petition is disposed of by directing the respondent No. 3 to consider the Representation dated 23. 03. 2020 and dispose of the same in accordance with law and by a speaking order within a period of one month from the date of receipt of a copy of the Order of this Court. With the above observations and directions, writ petition is disposed of.
