C. , the accused-petitioner, namely, Motiur Rahman @ Moti has sought for bail in connection with Hajo Police Station Case No. 1219/2020, registered under Sections 21(b)/29 of NDPS Act. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, appearing for the State. Also perused the case diary and the materials on record. The accused petitioner was arrested on 06. 11.
2020 and he contended that he has a family and children and sought for bail. The learned Additional Public Prosecutor has submitted that recovery was made from the possession of the accused person and FSL has not received. The amount seized in the instant case is 69 gram which is above the small quantity and below the commercial one. Considering all entirety of the matter and the length of detention it can be inferred that release of accused Page No. # 2/2 will not hamper the investigation. Accordingly, the present accused petitioner is hereby directed to be released on bail in connection with the case aforementioned on furnishing bail bond of Rs. 20,000/- with one suitable surety of the like amount each, to the satisfaction of the Special Judge, Kamrup(R), Amingaon.
