IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 5269 of 2024 ----- Suraj Gorai, S/o Durga Goarai @ Balomali Gorai @ Banamali Gorai, R/o Hurlung Zone No. 1B, Sadhudera, P. O. & P. S. -Birsanagar, District-East Singhbhum, Jamshedpur. .......... Petitioner. -Versus- The State of Jharkhand .......... Opp. Party. ----- CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Anurag Kashyap, Advocate Ms. Supriya Dayal, Advocate Mr. Pankaj Kumar, Advocate For the State : Mr. Pankaj Kr. Mishra, A. P. P. ----- Order No. 05 Date: 11. 12. 2024 1. The petitioner apprehending his arrest in connection with Birsanagar P. S. Case No. 71 of 2024 for the offences punishable under Sections 341/323/324/307/504/34 of the Indian Penal Code, 1860, has prayed for grant of anticipatory bail. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F. I. R.

The allegation made by the informant in the written report is highly exaggerated. The injuries allegedly sustained by the informant-Jagarnath Biruwa have been found simple in nature. Hence, no case under Section 307 of the I. P. C. is made out. Under the said circumstance, the petitioner may be given the privilege of anticipatory bail. 3. Learned A. P. P. though opposes the petitioner’s prayer for grant of anticipatory bail, however, while referring to the injury report of the informant-Jagarnath Biruwa (wrongly mentioned in the injury report as “Jagarnath Gurba”) submits that the injuries sustained by him have been found simple in nature. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. 5.

Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of st learned Judicial Magistrate 1 Class, Jamshedpur in connection with Birsanagar P. S. Case No. 71 of 2024 subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Rajesh Shankar, J. ) Vikas/ -2- A. B. A. No. 5269 of 2024
