IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6227 of 2020 --------- Chand Ansari ... … Petitioner Versus The State of Jharkhand ... … Opposite Party --------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --------- For the Petitioner : Mr. Gautam Kumar, Advocate For the State : Mr. S. K. Tiwari, A. P. P. --------- 02/15. 12. 2020 Defect no. 9(i) as pointed out by the office is ignored. Heard Mr. Gautam Kumar, learned counsel for the petitioner and Mr. S. K. Tiwari, learned A. P. P. for the State. The petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Noamundi P. S. Case No. 31 of 2018, corresponding to G. R. No. 346(S) of 2018. In a whatsapp group obscene post of goddess Durga was published. The same had hurt the religious sentiment of Hindus. The petitioner seems to have been implicated on the confession of co-accused Saddam Ansari. As per the confession of Saddam Ansari the obscene post emanated from the petitioner.

The petitioner does not have any criminal antecedent as stated in this application. On consideration of the fact that the implication of the petitioner is on account of the suspicion due to disclosure made by Saddam Ansari, I am inclined to extend the privilege of anticipatory bail to the petitioner. Therefore, the petitioner, named above, is directed to surrender in the court below within a period of four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, Chaibasa in connection with Noamundi P. S. Case No. 31 of 2018, corresponding to G. R. No. 346(S) of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed.
