Judgment text

IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 9806 of 2020 Binod Mahli … Petitioner Versus The State of Jharkhand … Opposite Party Coram: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY For the Petitioner : Mr. P. K. Mukhopadhyay , Adv. For the State : Mr. Tapas Roy , Addl. P. P. 02 / 16. 12. 2020 Heard the parties through Video Conferencing. Learned counsel for the petitioner personally undertakes to remove the defects pointed out by the Stamp Reporter within two weeks after the lockdown is over. In view of the personal undertaking given by learned counsel for the petitioner the defects pointed out by the Stamp Reporter are ignored for the present. Learned counsel for the petitioner submits that the prayer for bail of the petitioner has already been rejected by a co-ordinate Bench of this court on vide order dated 03. 09. 2019 passed in BA. No.

7400 of 2018 and the only fresh ground is that the petitioner has remained in custody for some more months since the said date of rejection of his bail application. Considering the fact that the prayer for bail of the petitioner has already been rejected on merit, this Court is of the view that remaining in custody for some more period is not a sufficient ground to re-consider the prayer of bail of the petitioner. Accordingly, the prayer for bail of the above named petitioner is rejected for the same reasons as mentioned in the order dated 03. 09. 2019 passed in BA. No. 7400 of 2018. Keeping in view the insufficient ground to reconsider the prayer for bail of the petitioner, notwithstanding any order in administrative side of this Court, the trial court is directed to take up the trial of the case expeditiously and to conclude the trial within six months from the date of receipt of this order by the trial Court.

It is made clear that the trial be conducted and witnesses be examined by observing the precautions relating to COVID-19 pandemic. (ANIL KUMAR CHOUDHARY, J. ) Smita/-
