This matter is taken up through hybrid mode. 2. Upon hearing from the learned counsels of both the sides, it is felt proper to dispose of this writ petition finally giving liberty to the petitioner to prefer an appeal before the Sub-Collector, Puri challenging the order of rejection passed in Mutation Case No. 674 of 2013 by the Tahasildar, Puri Sadar.
In case of filing an appeal by the petitioner annexing the certified copy of this order before the Sub- Collector, Puri, the Sub-Collector, Puri shall entertain the same without questioning about the limitation invoking the provisions under Section 14 of the Indian Limitation Act, 1963, as the petitioner had approached the wrong forum bonafidely by filing this writ petition Page 1 of 2. and the Sub-Collector, Puri shall dispose of the same on merit as per law within a period of three months from the date of filing the appeal. 3. As such, the writ petition filed by the petitioner is disposed of finally. 4. Urgent certified copy of this order be granted to the petitioner on proper application.
