IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6076 of 2020 ------- 1. Chandradeep Ram 2. Kagiya Devi 3. Alok Ram 4. Ranju Devi 5. Antesh Ram … … Petitioners Versus The State of Jharkhand … … Opposite Party ------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY Through- Video Conferencing ------- For the Petitioners : Mr. Sanjay Kr. Pandey, Advocate For the State : Mr. Anup Pawan Topno, A. P. P. ------- 02/04. 12. 2020 Heard Mr. Sanjay Kr. Pandey, learned counsel for the petitioners and Mr. Anup Pawan Topno, learned A. P. P. for the State. So far as defect nos. 3, 4, 5(e) and 9(i) are concerned learned counsel for the petitioner undertakes to remove the same once the situation normalizes. As regards, the rest defects are concerned, the same are ignored. The petitioners have prayed for grant of anticipatory bail, as they are apprehending their arrest in connection with Ketar P. S. Case No. 40 of 2020. It has been alleged that the wife of the informant was called a witch.

Some days ago the mother of the petitioner st no. 1 had died at which the allegations revived and on 1 of June, 2020 some hot exchange of word took place between both the sides which resulted in the accused persons assaulting the informant on his head. It has been stated by the learned counsel for the petitioners that the petitioners and the informant are gotias. It has further been stated that on account of the free fight between the parties a case was also instituted by the petitioner no. 1 being Ketar P. S. Case No. 39 of 2020. Learned counsel further submits that the present case has been instituted as a retaliation to the case instituted by the petitioner no. 1. -2- Learned A. P. P. for the State has opposed the prayer for anticipatory bail of the petitioners.

It appears that although the injury sustained by the informant was opined to be grievous in nature but so far as the narration in the First Information Report is concerned the same seems to indicate that there was a general assault made by the accused persons. Moreover, the First Information Report instituted by the petitioner no. 1 being Ketar P. S. Case No. 39 of 2020 further indicates that there was a free fight between both the sides on account of a quarrel. The said fact, therefore, invite this Court to grant anticipatory bail to the petitioners. The petitioners accordingly are directed to surrender before the learned court below within a period of four weeks and on such surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned st Judicial Magistrate 1 Class at Garhwa in connection with Ketar P. S. Case No.
