JUSTICE SANDEEP SHAH Order 10/08/2026 1. The applicant has filed the present bail application under Section 483 of BNSS being aggrieved against the order dated 10. 07. 2026 passed by the learned Additional Sessions Judge No. 1, Nagaur District, Nagaur, in Criminal Miscellaneous Case No. 442/2026, whereby the bail application filed by the accused-applicant under Section 483 of B. N. S. S. was rejected.
The accused-applicant is behind the bars, pursuant to the F. I. R. No. 217/2026 registered at Police Station Kotwali Nagaur, District Nagaur for the offences punishable under Sections 126(2), 115(2), 189(2), 333, 324(5) and 109(1) of BNS and Section 27 of the Arms Act, 2019. [2026:RJ-JP:37951] (2 of 3) [CRLMB-9431/2026] 2. Learned counsel for the applicant submits that as per the FIR itself, the allegation of trying to use the firearm is upon the co-accused Manish and there is no allegation against the applicant. He further submits that the allegation against the applicant was that he was carrying a sword, however, neither the complainant nor any other person from their side has suffered any injury whatsoever and they had rather refused to get medically examined as there was no injury. He further submits that the applicant is behind the bars since 04. 07. 2026 and the trial of the case will take sufficiently long time to conclude.
He, therefore, implores this Court to allow the present Criminal Miscellaneous Bail Application. 3. Per contra, learned Public Prosecutor as well as learned counsel for the complainant vehemently oppose the bail application and submit that since there is an allegation of use of firearm by the accused persons and the applicant is having criminal antecedents, the applicant does not deserve to be enlarged on bail. 4. Heard learned counsel for the parties and perused the material available on record. 5. Having considered the arguments advanced by both the sides and having regard to the facts and circumstances of the case, including the facts that there is no injury upon body of the complainant or any other person from their side, there is no allegation of using of firearm upon the applicant and there is no recovery from the applicant, the applicant is behind the bars since 04. 07.
