The petitioner has been made accused in connection with Manatu P. S. Case No. 27 of 2020, for the offence under Sections 147, 148, 149, 307 & 353 of the Indian Penal Code, Sections 25(1-B)(a), 26, 27 & 35 of the Arms Act and Section 17 of the CLA Act, pending in the court of Smt. Sonam Vishnoi, learned Judicial st Magistrate, 1 class, Palamau at Daltonganj. On 12. 06. 2020, T. P. C extremists were spotted in Khaparmanda forest.
Informant party raided the place of occurrence. On seeing the police party, there was encounter between the police party and the extremists. On being overpowered, extremists fled away. Incriminating articles were recovered from the place of occurrence. It was submitted that the petitioner was not arrested at the spot and no police personnel was injured in the said firing. It was further submitted that similarly situated co-accused persons have been granted bail by this Court as well as by the Coordinate Bench of this Court. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Smt. st Sonam Vishnoi, learned Judicial Magistrate, 1 class, Palamau at Daltonganj, or her successor, in connection with Manatu P.
