Ghosh, Addl. PP HON’BLE MR. JUSTICE ARINDAM LODH Order 01/10/2024 This is an application filed under Section 482(1) of the BNSS, 2023 for granting anticipatory bail to the accused-applicants in connection with Melaghar PS case No. 46 of 2024 registered under Sections 331(7)/118(2)/109/74/3(5) of the BNS Act, 2023. Heard Mr.

Prasanta Sen Chowdhury, learned counsel appearing for the accused-applicants. Also heard Mr. S. Ghosh, learned Addl. P. P appearing for the State-respondent. This Court vide order dated 19. 09. 2024 had released the accused-applicants on interim bail. It is submitted by learned counsel appearing for the parties that after being released on interim bail the accused-applicants did not interfere with the process of investigation and have not committed any further offence. I have perused the case diary as produced by learned Addl. PP. After perusal of the case diary, it is found that one person had seen them to inflict some blows on the husband of the complainant out of which he suffered some minor injuries. Learned counsel for the accused-applicants has submitted that it was a quarrel between the two groups belonging to some political parties. It is further submitted that there is no adverse report from the Investigating Officer against the accused-applicants.

In this circumstance, I am inclined to confirm the interim anticipatory bail granted to the accused-applicants on the previous date. Accordingly, in the event of arrest, the accused-applicants, namely Sri Prasenjit Chowdhury, Sri Dipankar Nama and Sri Tatan Sarkar shall be released on bail by furnishing a bond of Rs. 50,000/- (Rupees fifty thousand) each with one surety of like amount, to the satisfaction of the Investigating Officer. However, it is directed that the accused-applicants shall cooperate with the process of investigation and will not try to temper the evidence. In terms of the above direction, the instant anticipatory bail application stands allowed and disposed of. Case diary is returned.
