P-State: Mr. Rakesh Ranjan, A. P. P. --- 03 / 16. 12. 2024 Heard the parties. 2. Petitioner has been made accused in connection with Birni P. S. Case No. 90 of 2024 corresponding to G. R. No. 1791 of 2024 for the offences registered under section 376 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Giridih. 3. In the night of 28. 04. 2024, when the prosecutrix went outside her house to attend the call of nature, the petitioner accosted her and raped her. 4. Statement of the victim has been recorded under section 164 of the Cr. P. C.
in which she has stated that when she had gone outside her house, the petitioner established physical relationship with her. It further appears that father-in-law and brother-in-law of the Informant saw them in compromising position, due to which this case has been instituted. 5. From the statement of the victim recorded under section 164 of the Cr. P. C, it appears that the parties were in consensual relationship. 6. Accordingly, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Giridih in connection with Birni P.
