IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6048 of 2020 ------- Anita Devi … … Petitioner Versus The State of Jharkhand … … Opposite Party ------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY Through- Video Conferencing ------- For the Petitioner : Mr. Awanikant Prasad, Advocate For the State : Mr. Veervijay Pradhan, A. P. P. ------- 02/08. 12. 2020 Heard Mr. Awanikant Prasad, learned counsel for the petitioner and Mr. Veervijay Pradhan, learned A. P. P. for the State. The petitioner has prayed for grant of anticipatory bail, as she is apprehending her arrest in connection with Bishnugarh P. S. Case No. 54/2014, corresponding to G. R. Case No. 2440/2014. On 25. 09. 2013 a sum of Rs. 5,90,000/-was sanctioned to Hiralal Mahto for purchasing a tractor. An advance of Rs. 1,78,160/- was submitted by Hiralal Mahto to the proprietor of M/s Shiv Tractor. However, the tractor was not delivered even after receiving the money.
The petitioner has been implicated on account of the fact that she is the proprietor of M/s Shiv Tractor. It has been stated that there was some delay in delivering of the tractor and Hiralal Mahto had refused to accept such delivery. It appears that a no dues certificate has been given by the Bank as the sanctioned amount has been returned to the Bank. In such circumstances, therefore, I am inclined to extend the privilege of anticipatory bail to the petitioner. The petitioner accordingly is directed to surrender before the learned court below within a period of four weeks and on her surrender, she shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned S. D. J. M. , Hazaribag in connection with Bishnugarh P. S. Case No. 54/2014, corresponding to G. R. Case No. 2440/2014, -2-subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
