Majumder, Advocate. For the respondent (s) : Mr. D. Sarma, Addl. G. A. HON’BLE MR. JUSTICE ARINDAM LODH 14. 11. 2024 Order Heard Mr. S. Chakraborty and Mr. J. Majumder, learned counsel appearing for the petitioner. Also heard Mr. D. Sarma, learned Addl. G. A. appearing for the State-respondents. Mr. Sarma, learned Addl. G. A. appearing for the State-respondents has submitted that considering the fact that the son of the petitioner has been suffering from ‘Autism’ they have taken a lenient view in respect of the petitioner and she has been transferred to Resham Bagan Higher Secondary School from Narsingarh H. S. School. It is submitted that the posting place of the petitioner is just one and half KMs away from her residence and she being a Post-graduate teacher her service is badly needed by the respondents. In this circumstance, the Court is to grant equitious relief to the petitioner because it is a Court of equity.

In view of this, in my opinion, the transfer of the petitioner to Resham Bagan H. S. School should not be interfered with. Accordingly, it is not interfered. With the aforesaid order, the instant writ petition stands disposed of. JUDGE Digitally signed by SANJAY GHOSH SANJAY GHOSH Date: 2024. 11. 14 16:41:09 +05'30' sanjay
