Mohanty, ASC CORAM: MR. JUSTICE R. K. PATTANAIK ORDER Order 20. 01. 2026 No. 01. 1. Heard learned counsel for the respective parties. 2. No FIR is lodged. Recorded the submissions of learned counsels for the respective parties. As it appears, the petitioners have a dispute with the employee, namely, Kalu Sethi and apprehend their arrest as the latter might lodge a report with the th local police in respect of an incident dated 28 December, 2025. In fact, the petitioners have approached the learned Executive Magistrate, Bhubaneswar with an application filed under Section 163 BNSS with respect to the alleged incident alleging nuisance at the instance of the above named employee.
Considering the above facts and the fact that a report has been lodged by the petitioners at the local PS, a copy of which is at Annexure-3 and nature of dispute between them and the so-called employee, this Court is of the view that in the event, any case is registered after a report is received from the employee concerned, the petitioners shall not be arrested at least for a period of four weeks thereafter so as to enable them to avail regular bail before the court concerned having territorial jurisdiction or pre-arrest bail as the situation demands. 3. Accordingly, it is ordered. 4. In the result, the ABLAPL is disposed of with the direction as aforesaid. 5. Issue urgent certified copy of this order as per rules. (R. K.
