IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6103 of 2020 ---- Subodh Lohar. . ….. Petitioner Versus The State of Jharkhand. …. Opposite Party -------- Coram: THE HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY -------- For the Petitioner : Mr. Dilip Kumar Karmakar, Advocate For the State : Mrs. Nehala Sharmin, A. P. P. -------- 02/7-12-2020 Heard the parties. Defects, as pointed out by the office, are ignored. The petitioner apprehends his arrest in connection with Complaint Case No. 527 of 2019. It has been alleged that the petitioner had encroached upon the forest land and constructed a temple. It appears that a case has also been instituted for encroachment being B. P. L. E. Case No. 32 of 2019-2020, which is pending. The petitioner claims that the land in question devolved upon him from his father who had got the land on account of a deed of partition.
Since a plausible explanation has been submitted by the learned counsel for the petitioner apart from the fact that the encroachment proceeding is already pending, I am inclined to extend the privilege of anticipatory bail to the petitioner. Regard being had to the above, the petitioner, named above, is directed to surrender in the court below within a period of four weeks from today and in that event, he will be enlarged on bail, on furnishing bail bond of Rs. 10,000/- ( Ten thousand only) with two sureties of the like amount each to the st satisfaction of learned Judicial Magistrate, 1 class, Jamshedpur in connection with Complaint Case No. 527 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed. ( Rongon Mukhopadhyay, J) Rakesh/-
