Umakanta, GA Date of Order : 10. 08. 2020 ORDER(ORAL) Heard Mr. N. Surendrjit, learned counsel for the petitioner. Also heard Mr. R. K. Umakanta, learned Govt. Advocate for the state respondents. [2] The prayers in this writ petition are as follows:- “1) A writ in the nature of mandamus directing the Respondents to declare the Panchayat Secretary to be the official head of the concerned Gram Panchayat as WP(C) No. 110 of 2020Page 1 provided under the Manipur Panchayati Raj Act, 1994 and the Rules, 1995. 2) A writ in the nature of mandamus directing the Respondents not to bypass and supersede the Panchayat Secretaries in the execution/implementation of MGNREG Schemes/works and any other schemes at Gram Panchayat Level by the GRS, TA/SO, etc. or by any authorities as provided under the Manipur Panchayati Raj Act, 1994 and the Rules, 1995 as well as other guidelines.
3) A writ in the nature of mandamus directing the Panchayat Secretaries are the implementing/ executing authorities of all the schemes taken up by the Gram Panchayat including MGNREG and they are responsible, monitoring, supervising and control over financial/account matter of all the schemes/works as per the MPR Act, 1994 and related guidelines. 4) Any other relief or releifs which the Hon’ble Court deems fit and proper in the nature of the case. 5) cost of Litigation AND In the interim, it is prayed that Your Lordship be pleased to direct the Respondent No. 1 to consider and disposed of the Representation dated 26. 11. 2010 (Annexure-A/4) during the pendency of the Writ Petition for the ends of justice. ” [3] The prayer has been already answered by the impugned order dated 24. 7. 2020 challenged in W. P(C) No. 436 of 2020. Since the prayer has been answered in W. P(C) No. 436 of 2020, no further relief can be granted. Accordingly, the present writ petition is disposed of.
