Raval Hamendra Kumar ………….. Respondent(s). B) Cont. Cas(C) No. 75/2020 : Sri Raju Saha ………….. Petitioner(s). Vs. Raval Hamendra Kumar ………….. Respondent(s). For Petitioner(s) : Mr. A Bhowmik, Advocate. For Respondent(s) : None. HON’BLE THE CHIEF JUSTICE MR. AKIL KURESHI _O_R_D_E_ R_ 17/12/2020 The petitioners complain of non-implementation of the th directions contained in the judgment dated 5 August, 2020 passed in WP(C) No. 106/2017 and connected petitions. Page - 2 of 2 Learned counsel for the petitioners drew my attention to an order th dated 24 November, 2020 which the respondents passed pursuant to the said judgment of the High Court. He, however, submitted that the directions contained in the judgment were not correctly implemented. He submitted that the respondents have compared the performance of Smt.

Munmun Deb who was only one out of the two selected candidates under UR Category. However, in the process, the respondents failed to compare the case of another selected candidate namely Beda Prakash Banerjee who was granted substantial marks under “need criteria” and which the Court had asked the respondents to eliminate. When respondents have passed a speaking order pursuant to the directions of the Court, no case of contempt would arise. Even if the petitioner has genuine grievances with the manner in which such fresh order is passed, the same may be subject matter of a fresh petition but not of contempt. With these observations leaving it open to the petitioners to pursue their remedies in law, these contempt petitions are disposed of. ( AKIL KURESHI, CJ ) Sukehendu
