Judgment text

IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A No. 7437 of 2020 Mukesh Pujhar …. …. Petitioner(s). Versus State of Jharkhand …. …. Opposite Party(s) ------ CORAM : HON'BLE MR. JUSTICE ANANDA SEN. THROUGH : VIDEO CONFERENCING ------ FOR THE PETITIONER(S) : Mr. K. S. Nanda, Advocate FOR THE STATE : Mr. Nawin Kr. Singh, APP ------ 03/11. 12. 2020 Heard learned counsel for the parties through video conferencing. They have no complain with respect to the audio and video clarity and quality. Learned A. P. P. opposes the prayer for bail. The petitioner is an accused for allegedly committing an offence punishable under Sections 419, 420, 120(B) IPC. Petitioner is in custody since 5. 6. 2018. After perusal the status report it suggests that none of the witness has been examined till date in this case. Considering the period of custody and the fact that none of the witnesses has been examined in this case, I am inclined to allow this application.

Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the st satisfaction of learned Judicial Magistrate, 1 Class, Dhanbad in connection with Dhanbad Police Station Case No. 215 of 2018 (G. R. No. 2299 of 2018), subject to the condition that petitioner shall appear before the trial court once a month. Further condition that one of the bailers should be a close relative of the petitioner, having sufficient landed properties in his own name and the petitioner will not change his residence without permission of the trial court. I direct the Jail Authority that before releasing the petitioner from jail, the Jail Authority should get the petitioner tested for COVID-19. If the report is positive, then the District Administration will immediately take steps to isolate the petitioner and get him treated in COVID-19 centre by following all the protocols.

This direction is given in the larger public interest and it should not be construed as a condition of bail. (ANANDA SEN , J) anjali/ C. P 3
