IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No. 11977 of 2024 Hadia @ Hirasundar Mohapatra … Petitioner Mr. A. K. Pattanaik(A), Advocate -versus- State of Odisha … Opposite Party Mr. J. K. Bal, AGA CORAM: JUSTICE G. SATAPATHY ORDER(ORAL) 03. 12. 2024 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is the bail application U/S. 483 of BNSS by the Petitioner for grant of bail in connection with Dhenkanal Sadar P. S. Case No. 777 of 2024 corresponding to G. R. Case No. 1373 of 2023 pending in the file of learned SDJM, Dhenkanal, for commission of offences punishable under Sections 305(a)/111(6)/ 317(4) of BNS, on the allegation of receiving stolen property. 3. Heard, Mr. Ashok Kumar Pattanaik(A), learned counsel for the Petitioner and Mr. J. K. Bal, learned AGA in the matter and perused the record. 4.
It is submitted by the learned AGA that the present Petitioner is involved in 24 numbers of other similar cases, but when a question was asked to the learned counsel for the Petitioner as to whether the Petitioner is having any criminal antecedent, he simply replied that no criminal antecedent is reported against the Petitioner. Further, learned counsel for the Petitioner submits that no past conviction has been proved against the Petitioner. In this case, there is allegation against the Petitioner for receiving stolen property obtained in commission of theft by some habitual offenders. Further, no reference has been made in the bail application about the past criminal conduct of the petitioner, but the petitioner is allegedly involved in other cases also and right now the investigation is in progress. 5.
In view of the aforesaid facts and circumstances and taking into consideration the rival submissions, this Court is not inclined to grant bail to the present Petitioner at this stage. Hence, the bail application of the Petitioner stands rejected. 6. Accordingly, the BLAPL stands disposed of. 7. Issue urgent certified copy of the order as per Rules. (G.
