Shri Swapnil Ganguly, learned Deputy Advocate General for the respondent-State of M. P. The petitioner seeks quashment of order dated 07. 11. 2020 passed by Tehsildar, Kundam, District Jabalpur and a direction to respondents not to seal/seize the operation of Crusher operated over the land bearing Khasra No. 21 & 75/2 Mouja Amzhar, RC Imlai. 2- The proceedings in question, as evident from the pleadings and documents on record emanates from the complaint lodged by respondent No. 4 who is the mother of petitioner complaining of petitioner forcefully taking possession of stone crusher leased and licenced in her favour vide order dated 20. 09. 2011 for a period of 10 years from 03. 12. 2011 to 02. 12. 2021.
It is further evident from record that inter se dispute is going on between the petitioner alongwith his wife with respondent No. 4 and a Civil Suit No. 1120/2019 for permanent th injunction is also pending in the Court of 10 Civil Judge Class II, Jabalpur. 3- In view of these facts and more particularly the fact that the lease of Crusher is in favour of respondent No. 4 who is 2 W. P. No. 18321/2020 being protected by impugned order, we do not perceive any illegality in the order as would warrant indulgence. 4- Consequently, petition fails and is dismissed. No costs.
