This is a bail application U/S. 483 of BNSS Act by the petitioner for grant of bail in connection with Mohana PS Case No. 96 of 2024 corresponding to GR Case No. 49 of 2024 pending in the file of learned Sessions Judge-Cum-Special Judge, Gajapati at Paralakhemundi, for commission of offences punishable under Section 20(b)(ii)(C)/25/29 of NDPS Act, on the allegation of transporting 940Kgs of Contraband Ganja in a Bolero Max Pickup van bearing Registration No. OD-07-AR-2615. 3. Heard, Mr. Sudhir Ranjan Mohapatra, learned counsel for the petitioner and Mr. B. P. Nayak, learned Additional Public Prosecutor in the present matter and perused the record. 4.
After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-‡-vis the accusations sought to be brought against him and regard being had to the alleged seizure of such a huge (commercial) quantity of Contraband Ganja in a Bolero Max Pickup van bearing Registration No. OD-07-AR- 2615 in occupation of the petitioner and his consequent failure to satisfy the conditions of Section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioner. Hence, the bail application of the petitioner stands rejected. 5. Accordingly, the BLAPL stands disposed of. 6. Issue urgent certified copy of the order as per Rules. (G.
