Criminal Miscellaneous Bail Application No. 8977/2026 CNR: RJHC010619332026 | URN: CRLMB / 19480U / 2026 Rahul Kumar S/o Shree Mukesh Kumar Valmiki, Aged About 25 Years, R/o Gali No. 4, Sant Nagar Abohar District Fazilka (Punjab) (At Present Lodged In Central Jail Dist. Sri Ganganagar) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Jitendra Ojha For Respondent(s) : Mr. Hanuman Prajapati, PP HON'BLE MR. JUSTICE BALJINDER SINGH SANDHU Order 03/08/2026 Heard learned counsel for the parties, and perused the material available on record. The petitioner has been arrested in connection with FIR No. 119/2026 of Police Station Jawahar Nagar, District Sri Ganganagar, for the offences punishable under Section 8/21of NDPS Act. He has preferred this bail application under Section 483 of BNSS. Learned counsel for the petitioner submits that the alleged contraband, i. e.

, 28 grams of smack, was recovered from the main accused, Mukesh and Saurabh, and no recovery has been effected from the present petitioner. He submits that the charge-sheet has already been filed in the matter. Learned counsel further submits that, so far as the case against the petitioner is concerned, he has not been convicted in any of the cases registered against him. It is also submitted that the trial is likely to take considerable time to conclude. [2026:RJ-JP:36129] (2 of 2) [CRLMB-8977/2026] Per contra, learned Public Prosecutor has vehemently opposed the bail application. This Court has considered the arguments advanced by learned counsel for the petitioner and finds that the alleged contraband, i. e. , 28 grams of smack, was recovered from the main accused, Mukesh and Saurabh, and no recovery has been effected from the present petitioner. It is further noticed that the charge-sheet has already been filed in the matter.

So far as the criminal antecedents of the petitioner are concerned, it is submitted that the petitioner has not been convicted in any of the cases. Hence, keeping in view of the fact that conclusion of the trial of the case is likely to take time and the prosecution has not shown any apprehension of the petitioner fleeing away from justice, in case he is enlarged on bail and without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the petitioner under Section 483 of BNSS. Accordingly, this bail application filed under Section 483 of BNSS is allowed and it is directed that petitioner – Rahul Kumar S/o Shree Mukesh Kumar Valmiki, shall be released on bail in connection with aforesaid FIR, if not wanted in any other case, provided he executes a personal bond in the sum of Rs. 1,00,000/-with two sound and solvent sureties of Rs.

50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial. (BALJINDER SINGH SANDHU),J 75/Hanuman Ram
