Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. Petitioner is before this Court with the request to decide the Appeal no. 30/2020 (Dasharath Kushwaha vs. State of U. P. ) under Section 13 of Essential Commodities Act pending before Deputy Commissioner (Food), Varanasi. Learned Standing Counsel very fairly submits that in case any such appeal is still pending, the same shall be considered and decided by the Authority concerned expeditiously. In the facts and circumstances of the case, no useful purpose would be served in keeping the writ petition pending.
The writ petition, on consent, is disposed of with the direction to the Deputy Commissioner (Food), Varanasi to decide the aforesaid appeal so filed by the petitioner expeditiously, preferably within a period of six months from the date of production of copy of this order but certainly after providing ample opportunity of hearing to all the stake holders in the matter. It is made clear that meanwhile any settlement of fair price shop in question would be subject to final outcome of the said appeal. The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing. Order Date :- 2. 12. 2020 A. Pandey
