Judgment text

IN THE HIGH COURT OF MANIPUR AT IMPHAL W. P. (C) No. 1159 of 2018 Ph. Megha Singh …Petitioner -Versus- State of Manipur & 3 ors. ... Respondents B E F O R E HON’BLE MR. JUSTICE KH. NOBIN SINGH 03. 03. 2020 On 28. 11. 2019, this Court indicated two things possible for the purpose of disposing the writ petition- (i) the respondents shall proceed with the acquisition of the said land at an early date with certain amount being given to the petitioner as part payment of the compensation (ii) the respondents shall give the said land back to the petitioner within a reasonable time by restoring the said land to its earlier position by removing structures lying therein and by payment of compensation for the denial of the use of the said land by the petitioner for more than 6(six) years. Accordingly, learned counsel appearing for the State respondents was directed to seek instruction. As the instruction was not received by the learned GA, the matter was adjourned on two occasions.

When the matter is listed today for the same purpose, Mr. Neeranjan Sanasam, learned GA has placed before this Court two letters dated 20. 02. 2020 addressed to the Superintending Engineer, Rural Circle-III, PHED, Manipur by the Executive Engineer, Bishnupur PHE Divison, PHED Manipur and letter dated 20. 02. 2020 addressed to the Chief Engineer, PHED, Manipur by the Superintending Engineer, Rural Circle-III, PHED, Manipur, on record. On perusal of the said letters, it is seen that the office of the Chief Engineer has opined that the first option is more amenable and viable for the Government. The Chief Engineer is requested to move the Government for taking an appropriate decision as it is not known as to what action should be taken by the Government. The possession of the land of the petitioner has already taken by the Government for construction of water Treatment Unit under Urban Infrastructure Development Scheme of Small & Medium Town Cities (UIDSSMT) of MAHUD at Moirang.

The instant writ petition stands disposed of with the direction that the State Government shall take a decision within a month and the payment of compensation thereof may be made within five months from the date of the decision, after the process being completed in accordance with law. A copy of this order be furnished to Mr. Neeranjan Sanasam, learned GA for doing the needful.
