(Oral) The applicant is in judicial custody in FIR No. 333 of 2024, dated 17. 08. 2024, under Sections 64, 87, 137(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Sections 5 and 6 of the Protection of Children from Sexual Offences Act, 2012, Police Station Kichha, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 01. 08. 2024, the applicant enticed the victim, a young girl, under the pretext of marriage. 4.
Learned counsel for the applicant would submit that the victim has already been examined under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023; she has stated that the other persons had raped her; she want to stay with the applicant; the applicant has never committed any Galat Kaam with her. 5. These facts are not denied by the learned State counsel. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
